We would like to point out that we do not intend to collect personal data from persons under the age of 16, unless they have permission from their parents or guardian. Since we cannot verify that an individual is over the age of 16, we strongly encourage parents to be involved in their children's online activities.

Where we are required to collect personal information by law or under the terms of an agreement we have with you, and you do not provide the information requested, we may not be able to perform the agreement we have or are trying to enter into with you (e.g. . to provide you with products that you wish to order). Newsletter subscribers

We have a newsletter to inform interested parties about our products and/or services, contests, prize draws and other events. The newsletter is event based, meaning it is sent when certain events happen (such as a new product being launched). Your e-mail address will only be added to the list of subscribers with your explicit consent. The newsletter is aimed at stimulating engagement and may contain information about new products, promotions and events. We can measure when and to what extent newsletters are opened and which links in the newsletter you click. Each newsletter contains a link with which you can unsubscribe from our newsletter.

When you sign up for our newsletter, we process the following personal data:

  • Your email address;
  • IP address;
  • Open ratio and opening time;
  • Click ratio including timestamp related to URLs visited in our newsletters.

We process this data for the following purposes:

  • To send you our newsletter;
  • To analyze whether our newsletter is opened and to determine which parts of our newsletter are most interesting for our newsletter subscribers;

Legal bases for processing

We process your personal data based on one or more of the following legal bases:

To whom do we provide your personal data?

We do not provide your data to third parties ('recipients' within the meaning of privacy legislation), unless this is necessary for the proper implementation of the purposes described in this privacy policy. For example, in order to fulfill your order, we need to share your information with payment providers and transport companies. We may share personal data with our service providers, such as hosting providers, email services and (other) software providers, payment service providers, transport companies, lawyers, etc. Furthermore, we may share your data when necessary to defend the rights and or property of YOSMO and if necessary to protect the personal safety, property or other rights of the public, YOSMO or its customers or employees.

The third parties to whom the personal data is made available are obliged to treat your personal data confidentially. If these parties are regarded as 'processors' within the meaning of the privacy legislation, we ensure that a processing agreement is concluded with these parties that meets the requirements of the GDPR.

Your personal data may be wholly or partly involved in an acquisition of YOSMO; a sale of part or all of YOSMO; a merger or merger involvement; during a bankruptcy; dissolution or other transfer of our business. This means that your personal data may be transferred to a new owner or successor to ensure that our services can continue.

In order to provide our services, it may be necessary for us to transfer your personal data to a recipient in a country outside the European Economic Area that offers a lower level of protection of personal data than European legislation. In that case, YOSMO will ensure that such transfer of personal data is in accordance with the applicable legislation, for example by concluding a model agreement drawn up and approved for that purpose by the European Commission.

How long do we keep your personal data?

We will not keep your personal information in an identifiable form for longer than is necessary for the purposes set out in this privacy policy.

The personal data in our order administration will in principle be deleted no later than two years after the order concerned has been processed. The personal data used for website analysis is stored for a maximum of 24 months. The personal data in our service administration and customer marketing database is stored for up to five years after closing the customer file. The email address used for newsletter subscriptions will be removed from our mailing list once you choose to unsubscribe.

In principle, the personal data of suppliers will be deleted no later than two years after processing the order concerned.

In addition to the retention periods mentioned above, we may have to keep certain personal data to comply with legal retention obligations, such as the retention of certain accounting data for 7 years from the end of the year in which the data concerned shows their current importance for (tax) business operations in connection with our tax withholding obligation arising from Article 52 of the State Taxes Act.

The specific retention periods mentioned above may become longer or there may be statutory retention periods that we must adhere to. We may also keep personal data for longer if this is necessary for our legitimate interests, for example to resolve legal disputes.

Security of your personal data

We have security measures in place to reduce the risk of misuse, loss, unwanted disclosure and unauthorized access to personal data. Our employees and business partners are bound by confidentiality and are bound by instructions aimed at an adequate protection of your personal data.

We have put in place procedures to address personal data breaches and will notify you and the applicable regulatory authority of any such breach where we are required by law to do so. You have the following rights with regard to the processing of your personal data by us:

  • The right to object to the processing of your personal data or to restrict the processing of your personal data;
  • The right to withdraw consent to the processing of your personal data at any time, if the processing is based on your consent;
  • The right to receive or transfer your personal data by or to a third party designated by you in a structured, customary and machine-readable form ("right to data portability").

Please note that to prevent fraud and abuse, we may need to request specific information from you to help us confirm your identity. We may also contact you to request further information regarding your request. If you would like to view personal data linked to a cookie, please include a copy of the relevant cookie. You can find the cookie in your browser settings.

We will let you know whether we can comply with your request within one month of receiving your request. This period can be extended by two months in specific cases, for example in the case of a complex request. We will notify you of such extension within one month of receiving your request. On the basis of privacy legislation, we may refuse your request under certain circumstances. If we do, we will explain the reasons for the refusal. If you object to the processing of your personal data for direct marketing purposes, we will always respect this request. How can you submit a privacy complaint?

If you have a complaint about the processing of your personal data by us, we will do our utmost to resolve it together with you. You have the right to lodge a complaint with the competent supervisory authority at any time. In the Netherlands this is the Dutch Data Protection Authority. If you live or work in another country of the European Union, you can lodge a complaint with the competent supervisory authority in that country.

Changes to this privacy policy

We reserve the right to change this privacy policy and will always post the most recent version of this privacy policy on our website. If substantial changes are made that could significantly affect one or more data subjects, we will strive to inform the relevant data subjects immediately.
